摘 要:劳动者在工作中因第三人侵权而发生工伤的,会产生工伤保险补偿与侵权赔偿如何适用的问题,当前主要有替代模式、选择模式、兼得模式、补充模式四种适用模式。我国在工伤保险补偿与第三人侵权赔偿适用模式选择上,要综合考虑工伤保险与侵权赔偿的不同性质和功能,不仅使工伤者得到救济,而且要使侵权法的惩罚功能得以实现,同时,要避免双重赔偿,以节省社会保险基金。重复赔偿抵扣的兼得模式能较好的达到上述目标,应成为我国的选择。When employees in working incur damage caused by a third party, there will be a problem about how to select an applicable compensation mode between the employment injury insurance and the tortious damages. There are four applicable alternatives . When dealing with the problem, we should consider comprehensively the different features and functions of employment injury insurance and the tortious damages. We should not only remedy the injured laborer but also realize the penalty function of the tort law and at the same time avoid double compensation so as to save social insurance funds. A double compensation model from which the repeat compensations is deducted can achieve the above goal and it should be a better choice for China.
