农垦农地法律制度突出的问题及其对策——以海南国际旅游岛建设为背景

摘　　要：海南国际旅游岛建设正式上升为国家发展战略,给海南农垦农地法律制度的改革与发展带来了机遇,但也使其存在的一些问题更为突出,主要体现在职工承包经营权被侵犯,承包关系不稳定、农地资源被占用,土地规划利用制度不健全、土地被私下流转,农垦土地管理权限与职责不清几个方面,应采取保障职工承包经营权,稳定承包关系、保护基本农田,健全土地规划利用制度以及规范流转行为,完善国有资产管理等措施予以完善。The official upgrade of the construction of Hainan International tourism island as a national development strategy has not only brought opportunities for the reform and development of the legal system of farmland on state farms of Hainan but also aggravated some of the existing problems,as is evident in the following three aspects： firstly,workers＇ right to contracted management is infringed upon,the contract relationship is unstable and the farmland resources are occupied;secondly,the land planning and utilization system is not perfect,and land is in private circulation;and thirdly,there are no clear indications of farmland management rights and responsibilities.As such,efforts must be made to ensure workers＇ contracted management right,to stabilize the contracted relationship,to protect essential farmland,to improve the system of farmland planning and utilization,to standardize land circulation and to perfect the management of national assets,etc.
