摘 要:错案追究制受到理论界的广泛批评,错案追究权的来源、错案概念内涵和错案追究程序都成为诟病焦点。错案追究制的运行实效极差,存在受错案追究的个案少和错案曝光率高、法院独立审判权受限和错案责任独担、问责机制内部化和错案利害关系群体化三大矛盾。突破该制度应从外部着眼,深化审判公开,在全国人大下设错案惩戒机构来主导错案追究,同时应界定统一合理的错案标准和创设合理的追究程序。The misjudged case investigation system has received widespread criticism for the sources of investigation power, concepts of misjudged cases, and the procedures. The system is extremely ineffective in operation. There are three contradictions in the system: (1) Reinvestigated cases are few in number but high in frequency of exposure; (2) The court!s power of independent trial is con-fined but the responsibility of misjudging cases should be taken alone; (3) The system of accountability is carried out within the court but misjudged cases put lots of parties at stake. Breakthrough on this system should be started from the exterior, advocating public trial, and setting up institutions under the National People's Congress exclusively for dealing with misjudged cases. Furthermore, ra-tional standards and procedures for investigating misjudged cases should be uni-fied.
