摘 要:欧洲主权债务危机暴露出欧盟在经济治理上,尤其在财政监管上存在重大缺陷。长期以来,对马约中早已达成的预算和财政纪律,欧盟缺乏具有执行力的法律监管框架。在危机压力下,欧盟通过包括"六部立法"和"财政契约"在内的一系列法律措施,开始了加强经济治理、强化财政纪律和加大惩罚机制的进程。尽管,"财政契约"仍然是加强版的经济与货币联盟,却表现出了财政一体化的端倪。本文通过聚焦2011年以来的欧盟经济治理与财政监管立法进展,对欧盟新一轮制度建设进行全面梳理。当前,欧盟在危机之下被迫进行的制度建设,其影响和意义将远远超出经济治理的范围。欧盟正处在继续推进宪政的关口。The European sovereign debt crisis exposes that the EU lacks an enforceable legal and regulatory frameworks for enforcing those budgetary and fiscal disciplines which the 1992 Maastricht Treaty has already established.Under the pressure of the European sovereign debt crisis,the European Union and Eurozone have adopted a series of legal measures,including,inter alia,the 'Six Pack' and 'Fiscal Compact',in order to strengthen economic governance,enhance fiscal regulation and improve the punishment mechanism.Although the Fiscal Compact is regarded as an 'enhanced version' of the Economic and Monetary Union,some signs of the fiscal integration has already emerged.In view of this,this paper analyses the new round of institutional reforms on European economic governance and fiscal regulation after 2011 and concludes that its impacts will undoubtedly go beyond the scope of economic governance and that it will force the EU to resort to constitutionalisation.
