摘 要:预抵押登记是《物权法》规定的预告登记制度的一种,是在商品房未取得产权证书前,因借款人(购房人)向商业银行申请办理个人住房贷款的需要而设定的非正式抵押登记。在现行法律法规、金融监管和司法实践框架下,本文通过分析商业银行在业务经营中所面临的预抵押权行使、撤销、预抵押物查封、费用承担等诸多风险,提出商业银行防范和化解风险的可行性解决方案。Pre-registration of mortgage is one of the advance notice registration systems which is prescribed in Property Law, and is an informal registration of mortgage which is designed according to the demand that the borrower (the buyer) applies for personal housing loans from commercial banks before a commercial house gets its house property fight certificate. Under the framework of cur- rent laws and regulations, financial regulation and judicial practice, the paper analyzes a number of risks ofpre-mortgage exercise, cancellation, mortgage collateral seizures and cost which are faced by commercial banks during the business operation, and puts for- ward feasible solutions for commercial banks to guard against and defuse risks.
