摘  要:我国制定的《企业破产法》是采取了"分界式"的处理方式,用以解决工资优先权与担保物权之间所存在的矛盾冲突。法学界大多人士对"分界式"的研究,基本上是从劳动法或者民法的视角进行分析和研究。从经济法学的站位来分析和研究"分界式"立法,旨在充分显示经济法学所具有平衡、协调性的功能,是其不同于传统公法和私法的,实际上也就是经济法在兼顾多方利益的结果。Law of the People' s Republic of China on Enterprise Bankruptcy adopts the method of severance to deal with the conflict between wage priority and security interest in our country. Majority of researchers in the law field study severance with the method based on the perspectives of Civil Law and Labor Law. To analyze and study the purpose of severance legislation from perspective of economic jurisprudence, is to reflect the function of balance and integration of economic jurisprudence, and this phenomenon should be explained through the concrete illumination about the integration of individual and overall interests stressed in Economic Law, In fact it is also the reason of the integration of interests from every part stressed by Economic Law.
