知识产权视角下的中药保护及国际化战略

摘　　要：2010年的云南白药在美泄密风波至今未平,围绕这个话题,中药界、法律界展开了热烈的讨论。业外人士质疑云南白药在美国公开其配方,与国内实行双重标准,涉嫌泄露国家秘密和侵犯消费者的知情权;业内人士则看到了这起风波背后的中药国际化困局。究竟公开配方是否必然泄露商业秘密,中药国际化困局如何化解,中药的国际化道路如何走上正轨并最大化发挥我们传统知识的竞争优势,应从知识产权综合保护的角度探索出中药如何走出国门的一套可行性战略措施,为尽快解决中药国际化困局提供一个突破口和参照。The leak of the formulations of Yunnan Baiyao in 2010 caused a heated discussion in the fields of medicine and law. While the outsiders suspect it of divulging State secrets and violating the rights of Chinese consumers to expose the formula in the United States, the insiders see the plight in internationalizing traditional Chinese medicine. Does formula exposing inevitably lead to trade secret leak？ How can we internationalize the traditional Chinese medicine to maximize its competitiveness？ It is proposed that a set of strategic measures be regulated from the perspective of intellectual property protection to help traditional Chinese medicine go abroad.
