摘　　要：审判解释是最高人民法院对审判工作中的如何具体应用法律的问题所作的司法解释,是法律解释的核心。审判解释在我国的法制建设中起到了积极的作用,它对于填补法律空白和漏洞、保障国家法制统一、促进司法公正等方面都有着重要影响。审判解释的功能能否充分地发挥,在很大程度上取决于是否存在一个设计科学、合理的审判解释体系。通过对审判解释体系进行应然性解析,明确了审判解释体系重构的必要性和迫切性以及当代法治中国审判解释体系的应然模式。Judicial interpretation is the judicial explanation of specific application of law in trial works by The Supreme People＇s Court, and it is the core of legal interpretation. Judicial interpretation has played an important role in Legal System and has potive effects on legalizing loopholes and bridging current legislative gap, reassuring the unified legal system and promoting justice. Whether judicial interpretation can be functioning well or not has largely depended on a well-designed and reasonable interpretation system. We attempt to give explanation on judicial interpretation system, significance and urgency of reconstructing judicial interpretation system have been clarified and the model of in judicial interpretation system has been emphasized in contemporary law-ruling China.
