布图设计的产业化与布图设计权的现代化

摘　　要：传统的集成电路布图设计权制度因循专利法和版权法的保护理念,以"保护集成电路布图设计"之名行"保护集成电路产品"之实,忽视了对集成电路布图设计的独特保护。随着集成电路布图设计业的异军突起,有必要革新集成电路布图设计权的保护理念与具体制度,实现集成电路布图设计权的现代化。我国集成电路布图设计业尚处于起步阶段,与之相关的集成电路布图设计权有关规定也需作进一步完善。Traditional integrated circuit layout-design rights system follows the principles of patent law and copyright law,protecting integrated dircuit products in the name of protecting layout-design and ignoring specific protection of layoutdesign.With the high-speed development of layout-design industry,ideas and system of protecting layout-design rights need a more refined update.
