摘　　要：哈特将边沁的法律理论界定为法律实证主义,其中一个重要的根据是边沁的主权理论。然而,哈特将边沁的主权理论给误解了,而且也没有看到边沁这一理论更为深层的功利主义原理。与此误解密切关联的是,哈特对支撑边沁法律理论为实证主义的其它两个根据的理解也出现了严重错误。这最终使哈特的实证主义界定化为大错。H.L.A. Hart interpretats Jeremy Bentham＇s legal theory as legal positivism, and one of his arguments is Jeremy Bentham＇s theory of sovereignty. However, H. L. A. Hart misunderstands Jeremy Bentham＇s theory of sovereignty, and has not caught its deeper utiltarian rationale. Intimately connected with this, H. L.A. Hart makes serious mistakes in his two other arguments for the interpretation of Jeremy Bentham＇ s legal theory as legal positivism. All this contributes to the complete failure of H. L.A. Hart＇s interpretation of Jeremy Bentham＇s legal theory as legal positivism.
