摘　　要：学界对国际法渊源的定义莫衷一是。《国际法院规约》第38条不是对国际法渊源的权威表述。只有国际条约和国际习惯是国际法的渊源;一般法律原则、司法判例等仅是国际法的辅助渊源。Abstract：The definitions for international law can not be decided which is right among academic circle. Act 38 in Stat- ute of the International Cour~ of justice is not the authoritative explanation for the ,source of international ]aw. Internation- al treaty and international custom are the only ,source of international law~ general principle of law and judicial precedent are the supplementary source of international law.
