摘　　要：刑事诉讼背后往往有着复杂的法律与社会问题。围绕案件展开的争论与博弈,都有一定的理论支撑。权利、正义、秩序等价值位阶的争论、死刑存废的辩驳以及法治理念的分歧借助于特定案件或隐或显的表现出来。坚持正义最高位阶,寻求不同法律价值之间的适当妥协,才能最大限度地实现法律目的。The debate and game from the development of cases all have certain theoretical support. The debate about rights, justice and order, the argumentation on the existence and abolition of death sentence and divergence of legal philosophy are depicted implicitly or explicitly with the help of specific cases. The persistence of justice as the highest rank and the proper compromise among different legal values can greatly accomplish the legal purpose.
