行政民主化与行政指导制度发展(下)——以建设服务型政府背景下的行政指导实践作为故事线索

摘　　要：既往的诸多典型事例启示人们,当今的行政监管执法过程中必须树立现代依法行政观念,才能正确引导行政方式创新实践;建设服务型政府的背景下提出了诸多亟待解决的课题,首先就是必须重新认识政府的角色和职能,由消极行政转向积极行政、秩序行政转向服务行政、单纯的刚性管理转向柔性管理为主的现代行政模式,质言之,需要将政府的角色认知由"必要的罪恶"转变为"民众的伙伴";民主的基本品格是自由和平等,行政民主具体表现为体现广泛参与性、两造互动性、平等协商性、可自由选择性(民主四性)的行政方式创新,行政民主化不仅是世界潮流,也是我国渐次生发的行政革新过程;行政指导是行政监管执法和服务过程中的新事物,是代表性的柔性行政方式,行政指导的理念、特点、功能、类型、程序和救济制度值得认真研究和系统梳理,通过深化认识和立法建制,妥善运用并充分发挥出行政指导在建设服务型政府过程中的抓手作用;同时,行政指导行为的固有缺陷和负面效应也须高度重视、认真克服,努力实现行政指导行为的法治化,提升依法行政、民主行政、高效行政的水平,走出一条具有中国特色的行政指导制度发展道路。To promote administrative democracy, exercise the flexible management and build up a service o- riented government,we need to explore breakthroughs and grippers among which administrative guidance, as a flexible administrative mode, is just one of them. Administrative guidance is an administrative behavior widely used and gradually typed under the administrative democratization trend, and it is also a major administrative phenomenon with weak theoretical foundation, many practical questions and low degree of role of law. We should lead administrative guidance into the orbit of the role of law through updating concept and innovation system so as to develop its adjustment function in optimizing administrative management, improving the relationship be- tween administration and the people and enhancing the administrative efficiency. This is a significant subject in promoting administrative innovation and realizing administration according to law by thinking and doing in the way of rule of law. Professor Mo Yuchuan began his research in administrative guidance theory and practice 20 years ago. In this article, he assembles the realistic problems in macro, meso and micro, explores the trend of ad- ministrative democratization, problems and the cause of the systematic practice in administrative guidance, and fi- nally puts forward approaches and countermeasures for setting up modem administrative concept based on law, improving relationship between the government and the public, and promoting administrative guidance govern- ment by law,improving the construction of a service-oriented government ruled by law with the intention of provi- ding reference for administrative innovation experimenters and readers, promoting administrative guide exploration practice, and finding a way to developing administrative guidance system with Chinese characteristics. This maga- zine will publish the article respectively in two periods ,with the second part in this one.
