摘　　要：刑法没有对黑社会性质组织作界定,司法缺乏认定黑社会性质组织的实质标准,导致黑社会性质组织犯罪认定的疑难。为此,应将非法控制作为黑社会性质组织的核心特征,黑社会性质组织的其他三个特征围绕着非法控制特征证成黑社会性质组织犯罪。黑社会性质组织对内采用非法手段控制成员形成稳定的组织结构,对外针对不特定的人或多数的人通过实施违法犯罪活动非法控制一定的区域或行业获取经济利益。Because of the lack of identify of Mafia-styled organization in the criminal law, and the lack of essen- tial standards of Mafia-styled organization, it results in many questions of identifying Mafia-styled organization. So we should take illegal controlling as the main characteristics of Mafia-styled organization along with the oth- er characters to prove the crime of Mafia-styled. Mafia-styled organization illegally controls the members to form a steady structure, and controls certain regions and trades to obtain illegal interests by inhibiting related trading.
