摘　　要：集体土地征收中公共利益和补偿标准的开放性和动态性,强化了征地对程序正义性的依赖性。集体土地征收应当顺应参与式行政的发展趋势,进一步强调程序参与和程序平等原则,保障被征地人提前、全面和深度介入土地征收,强化其征收话语权,保障其土地财产权。从确定土地利用规划方案、认定公共利益、设计补偿安置方案、分配土地补偿款项、争议解决程序和司法救济机制等各个环节,都应当拓宽被征地人畅通、平等的参与渠道。In China＇ s collective land expropriation, the open and dynamic public interest and the standard of compensation has strengthened the degree of dependence on the procedural justice. Collective land expropria- tion should follow the development of participatory administration, further emphasis procedural participation and equality, and make sure that those whose land expropriated may participate comprehensively, deeply in advance, and let them fully exercise their rights of discourse and land property as well. The participatory channel should be widened from certain aspects, including the scheme of land use planning, public interest i- dentification, compensation and settlement, payment allocation, dispute settlement and judicial relief mecha- nism.
