摘　　要：科技发展是提高国家竞争力的关键,知识产权相关法律制度则是推动技术创新、提高国家科技水平的有力保障。知识产权自主创新能力的增强与法律保护力度加大是相辅相成的。提升科技竞争力是进行知识产权自主创新的内在动力,而加强知识产权法律保护则为自主创新营造良好的外部环境,所以应当将知识产权法律保护工作贯穿于自主创新的全过程。自主创新任重而道远,必须对它加以保护。但是,我国目前对于知识产权自主创新的法律保护还存在着很多问题,亟需完善。The development of science and technology is the key for improving the competitiveness of a country, and the intellectual property law system is a powerful guarantee for promoting the technological innovation and improving the science and technology level of a nation. The enhancing of the capability of independent innovation and the strengthening of the effort of intellectual property legal protection supplement each other. The enhancement of the scientific and technological competitiveness is the intrinsic motivation of independent innovation of intellectual prop- erty, and the strengthening of the legal protection of intellectual property can create a favorable external environ- ment for independent innovation. The legal protection of intellectual property should be carried out throughout the process of independent innovation. Independent innovation has a long way to go and we must protect it. However, the legal protection of intellectual property of independent innovation still has many problems that should be resolved.
