摘 要:作为普遍适用于所有民间文学艺术表达的保护模式,著作权制度的适用空间有限。作为著作权法下位规范的民间文学艺术表达保护条例应当与著作权法衔接,并使用统一定义的概念。对作为例外的民间文学艺术保护应当采取著作权框架外的特别权利保护模式,"特殊版权"并不可行。可以利用和适当改造现有的著作权制度,调整基于民间文学艺术表达及其衍生作品的传承、演绎、利用、传播活动而形成的权利义务关系,扩张著作权及与著作权相关的权利的适用空间,寻找保护民间文学艺术表达的变通路径。As a protective model that is pervasively applied to protect all artistic expressions in Chinese folklore, Chi- na' s copyright system has limited applicability. Regulations concerning protecting artistic expressions in Chinese folklore, which are subordinate to the copyright law, should be consistent with the copyright law and go by unified definitions. This paper argues that the model of "special copyright" protection beyond the framework of current copyright law that has been a- dopted to protect special artistic expressions in folklore has not worked well. It is suggested that the existing copyright sys- tems should be utilized and modified to adjust the jural relations formed in the process of inheriting, performing, utilizing and disseminating the artistic expressions of folklore and its derivative forms, expand the application of copyright and copy- fight-related rights, and seek an alternative approach to protecting artistic expressions in Chinese folklore.
