摘 要:作为协调劳动关系的基本制度,集体协商对于确保劳动者合法正当权益、创新社会管理模式、促进社会和谐稳定发展具有重要作用。我国经过多年的探索已形成了具有中国特色的集体协商制度,但实践中仍存在影响集体协商落实的制约因素。因此,需要进一步建立健全集体协商法律机制,明确政府定位,发挥工会作用,提高企业积极性,保障劳动者权利,从而使政府、工会、企业、劳动者在集体协商中都能依据法律来规范自身的行为。As a basic institution to coordinate labor relations, collective negotiation plays an important role in protecting employees' legal rights, changing the model of social management, and promoting a harmonious society. China has already de veloped a system of collective negotiation with its own unique characteristics. Nevertheless, it still has some limitations in prac tice. It is necessary to improve and perfect the legal mechanism of collective negotiation, provide a clear definition of the gov ernment position, harness the power of the trade unions, enhance the initiative of the employers, guarantee the rights of the employees so that the government, trade unions, employers and employees can follow certain norms of practice in conformity with the laws.
