循环经济视野下的城市生活垃圾处理法律研究

摘　　要：我国城市生活垃圾科学处理起步较晚,存在诸多问题,其中包括相应的法律法规不够健全,尤其是对依循环经济理念进行城市生活垃圾处理的立法研究尚处于探索阶段。文章立足于国情,在明确城市生活垃圾处理与循环经济密切联系的基础上,通过对各典型国家在城市生活垃圾处理法制上的分析比较研究,提出完善我国城市生活垃圾处理法制的建议。即以法律的不断健全达到城市生活垃圾循环利用的目的,最终保障城市生活垃圾处理实现减量化、资源化和无害化的目标。In accordance with the delay in the scientific disposal of urban domestic refuses, many problems are existed, including inadequate laws and regulations, particularly the legal research is under the exploration phases in line with the circular economy ideas that carry out urban domestic refuses disposal. The paper is established in the situation of the country. Based on the closing relationship between the urban domestic refuses disposal and circular economy, and though the analysis, com- parison and research on the law system of urban domestic refuses disposal from the typical countries, the paper puts forward the suggestions in perfecting the law system of the urban domestic refuses disposal, so as to reach the goal on recycling the urban domestic refuses and finally to safeguard and realize the minimization, resource and harmlessness.
