土地换保障制度的逻辑困境与出路

摘　　要：研究目的:分析土地换保障制度面临的逻辑困境,并寻求走出困境的出路。研究方法:以文献法为基础,综合运用集体所有制、社会保障及"农转非"后地价增值分配基本理论,分析土地换保障面临的逻辑困境。研究结果:土地换保障制度在参保主体选定、保险项目选择、保障水平确定、保障资金筹集4个方面均面临多重困境。研究结论:土地换保障制度难以彻底解决征地补偿水平偏低问题,也难以建立真正现代意义的社会保障制度。走出困境的出路在于:一方面,政府勇于担当被征地农民社会保障制度建设责任;另一方面,继续深化土地制度改革,限制征地公权力,打破地方政府土地一级市场垄断地位,改革不合理的财税体制,剥离地方政府城市建设主导者的职能。The purpose of this paper is to analyze the logic dilemmas of the so-called Exchanging Land for Social Securit（y ELSS）policy,and further propose some countermeasures for the difficulties.Comprehensive analysis method and literature review are employed.The logic dilemmas of the ELSS policy include four aspects,i.e.,1）identifying the subject of social insurance,2）selecting proper insurance program,3）designing the insurance levels,and 4）ensuring the source of social security funds.The paper concludes that the ELSS policy cannot be a proper social security system for those land expropriated peasants,and it is not the suitable way to increase land compensation,given the ELSS policy is actually a special distribution method of land increment revenue.In the long term,public power should be restricted,such as monopoly position of local governments in land market should be replaced,unreasonable fiscal and taxation systems must be reformed,and the leading role of local government in urban development must be changed.
