摘  要:研究目的:探寻日本建筑物区分所有的立法历程,分析总结立法经验。研究方法:采用文献资料法和定性分析方法探讨日本国建筑物区分所有之法律制度。研究结果:日本在1962年开始制定建筑物区分所有专法,区分所有制度雏形初现;1983年大幅度修正,条文由37条增加到70条,建筑物区分所有制度由此建立;2003年修订是应对20年来社会变化而做的若干法条细节变动。研究结论:中国经济发达或较发达地区人口密度大,经济发展背景与日本相似,在《物权法》实施后,中国有必要针对本国的人文社会环境,构建建筑物区分所有的法律制度。The purpose of this paper is to analyze and summarize the historical experience on Japan Condominium Law.Methods employed include literature material analysis and qualitative analysis.The results indicate that 1)Japan Condominium Law was made in 1962,and it was the origin of condominium system.2)The law was made extensive amendment in 1983 with articles being added from 37 to 70,and condominium system was established from then on.3) The amendment in 2003 was just about some details in some articles according to social changes in the past 20 years.It is concluded that we need to take examples from Japan and build a condominium law system after the implementation of the Property Law according to our own humanistic and social environment,taking account of that we have a high density of population in developed or comparatively developed areas and the background of our economic development is similar to Japan.
