防范外资非正常撤离的国际合作法律机制研究

摘　　要：随着我国对外开放程度的扩大,外资的不断涌入成为一把双刃剑,在促进我国经济向国际化方向发展的同时,也对我国的国内市场环境及法律环境产生一定的不利影响,其主要表现形式是外资企业的"半夜出逃",即外资在我国的非正常撤离。外资非正常撤离无论对国家、企业,还是对债权人、企业的劳动者都会造成极为严重的后果,甚至影响到社会的和谐稳定,它在对我国经济发展发起挑衅的同时,也对我国的法律制度提出挑战。因此,通过对外资非正常撤离的现象进行原因剖析及其解决机制的研究,在当今纷繁复杂的国际经济法律背景下,构建一套可以有效预防外资非正常撤离的国际合作法律机制,具有重要的理论价值和现实意义。With the expansion of China^s opening to the other countries, the continuous investment of for- eign capital has become a double-edged sword, which on the one hand, promote China＇s economic develop- ment, and on the other hand influence China＇s domestic market and legal environment in recent years as well, such as ＂to flee at the middle of the night＂, namely non-normal evacuation of foreign investment, which will bring negative influence on states, enterprises and the creditors, and even the social safety. It initiated provocation to China＇s economic development and poses a challenge to China^s legal regulation. Therefore, in today＇ s complex international economic and legal context to build a set of effective law mechanism of international cooperation to prevent foreign non-normal evacuation mechanism through Cause Analysis and study of resolution of the mechanism of the phenomenon of the non-normal withdrawal of foreign investment has important theoretical value and practical significance.
