摘  要:"不动产二重买卖"原则上有有效的法律依据,但是会导致第一买受人的法益受到损害,虽然通过其他方式可以救济其利益,但是最好的解决方法是实现本来的合同内容。在不动产二重买卖中,韩国民法第103条反社会性条款试图解决一般债权理论产生的对保护第一买受人的限制。可是在韩国民法系统中,就此会产生跟第746条不法原因给予的关系的问题,进而产生债权者代位权成立与否的问题。虽然反社会性无效合同因不法原因给予不可请求返还,但是为了保护第一买受人的利益,按照如上条款的立法主旨,通过对法条的再解释可以认定其返还,进而可以达到使第一买受人能够取得标的物的目的。In principle,real estate dual sale is valid,but it can infringe the first buyer of the legal benifit.Although this problem can be solved through other ways,but the best method for solving it is to make the first buyer carry out its contract.Therefore,for the double contract of real estate,according to the article 103,the South Korean Civil Law tries to solve the problem that the general contract theory would cause limitation of protecting the first buyer's legal benefit.But due to Korean civil law system,it would cause a problem of relation with the transfer of property for illigal reason in the article 746,and then it can cause the question of whether obligee's right of subrogation can be established or not.In order to protect the first buyer,although in antisocial invalidity contract the right of requesting the return can not be given due to illegal reasons,but in accordance with the above terms of the legislation,through the re-interpretation of law clauses,the first buyer is able to achieve the purpose of getting the subject matter.
