摘 要:临时保全措施现已成为国际商事仲裁中一个重要的程序问题,但仲裁庭作为仲裁程序实施的主体,各国对其是否有权决定临时保全措施,并且在何种程度上有权决定都仍尚存异议。在支持仲裁的理念和确保仲裁程序顺利开展的要求下,仲裁庭对临时保全措施的决定权应在合理限制的基础上加以确认并有所扩展。我国法律尚未赋予仲裁庭临时保全措施的决定权,这既有碍于仲裁实践,也有悖于国际潮流,因此应当予以改变和完善。Interim measures of protection has becomes a critical procedure in international commercial arbitration.Even though arbitral tribunal plays an essential role in the arbitral proceeding,states still hold different opinions on whether arbitral tribunal possesses the authority to order interim measures and to what extent arbitral tribunal may exercise its power.Since the principle of pro-arbitration has been widely accepted and arbitral tribunal should have the power to control the proceeding,arbitration statutes should move towards a willingness to permit arbitral tribunal to grant interim measures under certain condition.However,the Chinese legislation tends to prohibit arbitrators’ power to order any provisional measures,which is not conducive to the practice.Hence,it is necessary to improve the legislation in China.
