无居民海岛开发利用的法律问题探析

摘　　要：作为海洋经济发展的新模式,无居民海岛开发利用涉及到诸多法律问题:无居民海岛开发利用的许可;无居民海岛开发利用的使用金;无居民海岛开发利用与保护;无居民海岛违法开发利用的法律责任。正确解决这些法律问题,将有利于进一步规范无居民海岛开发秩序,建立无居民海岛保护管理长效机制,实现无居民海岛开发利用的可持续发展。As a new mode of marine economy,development and exploitation of uninhabited islands involves a series of legal essues： lieence to develop and exploit uninhabited islands; payment to develop and exploit uninhabited islands ; protection with development and exploitation of uninhabited islands ; legal liability to illegally develop and exploit uninhabited islands. To solve these issues correctly is advantageous to further standardize the order of development of uninhabited islands, establish long - term management meehanism of uninhabited islands,realize sustainable development and exploitation of uninhabited islands.
