摘　　要：教唆、帮助侵权行为是一种特殊的侵权形态,《侵权责任法》第9条虽有规定,但不尽明确。因此,如何界定教唆侵权与帮助侵权行为,怎样确定教唆行为、帮助行为和损害的因果关系,如何确定侵权责任的承担,保证恢复受害人的损失,同时平衡教唆人、帮助人与被教唆人、被帮助人之间的利益,值得在理论上进行积极的探讨。Solicitation,help a tort is a kind of special tort form,the tort liability law article 9 has a regulation,but not clear.Therefore,how to define the abet infringement and help infringement behavior,how to determine the solicitation behavior,help behavior and damage of causality,how to determine the right infringement responsibility,guarantee for the recovery of the loss,and at the same time balance solicitation,help people and be instigated by helping people,between the interests,and in theory for positive discussion.
