摘  要:农村生态保护在法制体系中被边缘化、农村生态资源权利主体虚位、农村生态损害缺乏救济机制,是我国农村生态保护陷于困境而面临的制度性难题。只有在立法上明确农民对农村生态资源的权利主体地位,赋予农民对农村生态的保护利用、知情参与、救济等权利,使农民可以基于自己的生态权益在立法上争取发言权,才是解决农村生态问题的长效机制和根本出路。因此,我国立法应尽快规定农民生态权,并保障农民生态权各项权能的实现。The rural ecological protection marginalized in legal system, rural ecological resources rights entities phantom and rural ecological damage lack of relief mechanism is institutional problems which ecological protection in dilemma in rural facing. Only defining the farmer's right subject position of rural ecological resources in the legislation, giving farmers rights on rural ecological of protection and utilization, informed participation, relief and so on, farmers can strive for the right to speak in the legislation based on their ecological interests, and this is the long-term mechanism and the fundamental way to solve the ecological problems in rural areas. Therefore, the legislation of our country should as soon as possible require farmer' s ecological rights, safeguard the realization of farmer' s ecological right and power.
