社会转型中夫妻共同债务初探

摘　　要：文章对目前我国婚姻法律关于夫妻共同债务的性质、范围、处理原则、法律后果等内容作了分析研究。指出我国夫妻共同债务的法律规定已明显不能适应社会转型中的实际 。The paper has analyzed the nature,scope,principles and legal consequences of joint debts of conjoint stipulated in Chinas Marriage Law,pointed out that the stipulations concerning the joint debts of conjoint obviously do not suit the social reality in the transitional period,and put forward some suggestions for the legislators in perfecting this law.
