摘　　要：近年来 ,单位犯罪呈上升趋势 ,其原因一是市场经济环境为其提供了客观可能性 ,二是行政管理上的漏洞 ,三是立法不完备和打击不力。单位犯罪的刑事防治在坚持“两罚制”原则的同时 。In recent years,crimes have been on the increase.The reasons are the objective feasibility provided by the market economic environment, loopholes in administration, incompleteness of legislation and unthorough crackdowns on crimes. Criminnal prevention and cure of legal person crimes should strengthen legislation of trial procedures and cling to the principle of 'punishment on natural person and legal person'.
