渭河干流陕甘省际水事纠纷调处案例解析

摘　　要：省际水事纠纷涉及不同的行政区域,纠纷双方缺乏直接沟通协调机制,调解难度较大,处理不慎,易酿成严重后果。以渭河干流陕、甘两省交界凤阁岭河段发生的一起水事纠纷为例,详细剖析了调处过程及措施。该案例省际水事纠纷的成功调处,有以下两条基本工作方法值得借鉴:一是相关水行政主管部门在接到省际水事纠纷报告时,迅速反应,及早介入,控制事态,为妥善解决纠纷赢得时间;二是在水事纠纷调处时,应当开展翔实的现场调查研究,掌握第一手资料,抓住矛盾焦点,从维护双方权益出发,依法开展平息纠纷和化解矛盾工作。The inter-provincial water dispute involves different administrative areas and it is possible far lacking of direct communication and coordi- nation mechanism between both sides. Improper disposal will make serious consequences easily. Taking the water dispute occurred in the Fenggeling River reach of the Weihe River at the junction of Shaanxi and Gansu provinces as an example, this paper analyzed the mediation process and measures adopted particularly. The successful mediation of this case highlights two basic methods in disposing water dispute ： firstly, the rele- vant walcr administrative departments response rapidly after receiving the report of inter-provincial water dispute, intervene early, control the situa- tiun and gain time for proper disposal of water dispute; secondly, it should carry out detailed field investigation, master the first hand information, grasp the focus of contradiction, mediate and dispose the dispute and conflict according to the relevant laws and regulations to safeguard the rights and interests of both sides.
