WTO金融服务中跨境提供与境外消费关系的廓清

摘　　要：在WTO金融服务贸易中,跨境提供与境外消费之间关系混沌,不利于确定成员方作出的金融承诺和承担的义务,亟待廓清。由于金融服务业具有不同于其他服务部门的特性,有必要以有效监管和消费者保护为主线,对伴有招揽和不伴有招揽的金融服务进行区分,将因招揽而发生的金融交易归类为跨境提供,以便作出承诺的WTO成员方对据此发生的金融服务进行有效管控,将未经招揽而发生的金融交易按照金融交易发生地而非金融服务交付地来确定其归属。In WTO trade in financial services, the relation between cross-border supply and overseas consumption is in chaos, which is not conducive to the con- firmation of the financial commitments of WTO members and their obligations and thus needs to be clarified. Because financial services industry has the features different from other service sectors, it is necessary to highlight effective supervision and consumer protection and differentiate financial services with solicitation from the ones without solicitation. It should classify financial transactions with solicitation as cross-border supply so that WTO members making commitments could effectively regulate financial services with solicitation, and deter- mine the attribution of financial transactions without solicitation according to financial trans- action places rather than delivery places of financial services.
