摘　　要：量刑监督是检察机关法律监督职能的体现,是审判监督工作的重要内容之一。要使量刑监督职能依法、充分、有效的行使,就必须通过各种途径加强对其权力的制约和监督,确保量刑监督过程、结果的公平、公正。量刑监督制度的运行,必须以完善的制约机制为前提。一要建立检察机关内部的制约机制,二要充分重视被害人的量刑意见,三要建立被告人及其辩护人的制约机制,四要完善侦查机关刑事侦查活动的制约机制,五要完善审判机关对量刑监督工作的外部制约,六要完善人大对量刑监督工作的监督制约,七要完善人民监督员对量刑监督工作的监督制约,八要完善社会舆论对量刑监督工作的制约。Sentencing supervision is the embodiment of the legal supervision of procuratorial organs, is one of the important contents of the trial supervision. In order to make sentencing supervision according to law, the full, effective exercise, it is necessary to strengthen the restriction and supervision of power through various channels, to ensure that the sentencing supervision process, results of the fair. Sentencing supervision system, to perfect the restricting mechanism must be the premise. One is to establish the restriction mechanism of the procuratorial organs of the internal, two full attention must be paid to the victim sentencing opinion, three to restrict a mechanism to establish the defendant and his counsel, four is to perfect the restriction mechanism of criminal investigation, the investigation organ, five is to improve the judicial organs of the external supervision mechanism, six is to improve the supervision of the National People's Congress on sentencing supervision control, the seven is to improve the supervision of people's supervisors of sentencing supervision control, eight is to improve the social public control of sentencing supervision.
