摘 要:控制性详细规划(下面简称"控规")在我国已经运行了20多年,各级地方政府在不断总结经验的基础上,对控规的技术内容和运作方式进行了持续的更新与改进,但在实践中仍不断凸显其制度建设滞后的弱点。针对控规制度层面的目标设定、制度设计和内容构成这三大要素,本文对美国的区划法和香港的法定图则制度进行三要素的简要剖析。通过经验借鉴,提出我国控规制度优化的建议,其中包括:明确控规制度的价值观与目标、完善控规修编与修改的程序、完善建设项目审批的程序、加强公权的制衡与监督制度、改善规划救济与公众参与机制、加强适应性调整机制、增加空间形态控制内容等。Regulatory Plan hasbeen practiced in China for more than 20 years. Based on the previous experience the contents and the working process of Regulatory Plan have been improved constantly. But in the current practice, the weakness of this system has been more and more obvious. From the angles of target setting, system design and plan contents, this paper tries to explain how the American zoning system and Hong Kong s Statutory Plan system work. Based on their experience, this paper initiates three groups of improvement suggestions to the current Regulatory Plans mechanism These include: to clarify the value and target of the plan, to improve the plan-making and amendment process, to improve the planning application process, to strengthenthe monitoring system planning appeal and pub process, to inject more f nject more urban design the system to improve the lic participation exibility, and to consideration in
