论循环经济法生态人模式的构建

摘　　要：文章在对已有关于生态人模式研究进行评述的基础上,结合构建法学人的模式的基本原则,从人的理性水平、人性要素、目的要素以及环境要素四个方面对生态人模式的内涵进行了剖析,而后厘清了生态人模式的伦理基础,否定了非人类中心主义以及强化的人类中心主义,指出应以弱化的人类中心主义作为生态人模式的伦理基础,最后文章结合我国循环经济促进法,从生态人模式的四个内涵出发论证循环经济促进法所预设的"人"与笔者所构建的生态人模式是相契合的。Based on the review of the existing eco-mode, this article analyzes the connotation of the eco-mode from four aspects including the rational level, human factors, objective elements, and environmental elements combined with the basic principles of building jurisprudence person mode.Then this paper clarifies the ethical basis of the eco-mode, denies non-anthropocentrism and enhanced anthropocentrism, and indicates the ethics basis of eco-mode to be the weakened anthropocentrism. Eventually, the article demonstrates the accordance between the presupposed 'man' by Circular Economy Promotion Law and the eco-mode built by the writer from four connotation of the eco-mode combined with Chinese Circular Economy Promotion Law.
