摘　　要：国有公司投资举办的高校是当前我国民办教育体系中的一支生力军,但由于相关法律设置的不完善,使得此类高校在法律上的公益性要求与实践中的营利性表现问题突显,如果不能处理好两者之间的关系,则不仅会造成此类高校在管理运作上的不规范,也不利于教育体制改革的健康发展。因此,在法律上对此类高校给予明确的定位,从本质上将其明确分为营利性与非营利性,更能促进其有序健康发展。Colleges and universities held by state owned company are a force in the current Chinese private education system,but due to the imperfect related legal settings,problems between public welfare in legal requirements and profit performance in practice are apparent.If we can＇t handle the relationship between the two,it will lead to non-standard in the management and operation of norms in this kind of colleges and universities,which is not conducive to the healthy development of education system reform.Therefore,it will be more helpful to give clear positioning to such colleges and universities in the law and to divide them clearly into profit and non-profit in essence.
