现阶段我国民商事冲突解决方式的法经济学选择

摘　　要：民商事冲突虽然纷繁复杂,但解决方式多种多样。选择冲突解决的途径应从自身经济条件、冲突事件的客观情况以及解决方式的投入成本等多方面考虑。从法经济学角度对我国现阶段民商事冲突解决方式的成本进行比较分析,可以发现各类民商事冲突解决方式往往成本、利益互补。应构建多元化救济机制,合理配置纠纷救济资源。The confliet of eivil and commercial ease is complex, but there are. so many ways to solve. Choosing the conflict resolution approaeh should consider the economic conditions, objective conditions and tile input costs of solution method of conflict evenls and so on many aspects. The article analysis the cost of the solution on civil and commercial conflicts at the present stage in China from the angle of law and economics, we can find all kinds of civil and commercial conflict solution often have complementary cost and interests, so we should build a diversified relief mechanism, rationally allocate the resources dispute relief.
