1979～1998年司法精神病鉴定案例的分析

摘　　要：目的　探讨 1979～ 1998年司法精神病鉴定变化的特点。方法　以 1989年《精神疾病司法鉴定暂行规定》颁布为界 ,对 1979～ 1998年经南京医科大学附属南京脑科医院司法精神病鉴定的1894例案例 ,进行前后 10年 [1979～ 1988(1979～ 1988年组 ,5 49例 )及 1989～ 1998年 (1989～ 1998年组 ,134 5例 ) ]的比较。结果　 (1)刑事责任能力鉴定减少 (1979～ 1988年组和 1989～ 1998年组分别为88 5 %和 83 1% ;P <0 0 1) ,精神损伤、行为能力和服刑能力鉴定增加 (1979～ 1988年组分别为 1 3% ,0 0 %和 0 0 % ,1989～ 1998年组分别为 3 8% ,1 8%和 0 8% ;P <0 0 1～ 0 0 5 ) ;(2 )鉴定诊断中精神分裂症减少 (1979～ 1988年组和 1989～ 1998年组分别为 38 8%和 2 7 0 % ;P <0 0 1) ,生理性醉酒和无病增加 (1979～ 1988年组分别为 0 4%和 15 7% ,1989～ 1998年组分别为 1 4%和 2 5 4% ;P <0 0 1～0 0 5 ) ;(3)凶杀案、流氓案和政治案减少 (1979～ 1988年组分别为 37 0 % ,12 5 %和 4 8% ,1989～ 1998年组分别为 2 8 4% ,6 9%和 1 2 % ;P <0 0 1) ,盗窃案增加 (1979～ 1988年组和 1989～ 1998年组分别为13 8%和 2 4 3% ;P <0 0 5 )。 (4)有责任能力和限制责任能力鉴定增加 (1979～Objective To explore the characteristics of psychiatric expert testmony from 1979 to 1998 Methods According to the time that“Interim Enactment in Forensic Psychiatric Assessment” was enacted in 1989,a comparative study was conducted between 549 cases from 1979 to 1988 and 1 345 cases from 1989 to 1998 Results Assessments of criminal responsibility, patients with schizophrenia, and homicide, villain, political cases and those without responsibility in 1989 1998 were significantly lower than in 1979 1988 (P<0 01), and the assessments of mental hurt, capacities for legal transactions and serving a sentence, (P<0 01 0 05), and no psychosis, physiological drunkenness (P<0 01 0 05), steal (P<0 05), and whole or partial responsibility (P<0 01 0 05) were significantly higher in 1989 1998 than in 1979 1988 Conclusion The contents in the assessment of forensic psychiatry have changed greatly in 20 years The identifiers should be continually improved to adapt these changes
