摘　　要：在《侵权责任法》实施前后的医疗侵权民事责任鉴定工作中,由于对最高人民法院《关于参照〈医疗事故处理条例〉审理医疗纠纷民事案件的通知》的理解偏差,出现在医疗侵权民事责任鉴定工作的"二元化"问题。通过分析现有两种鉴定的缺陷,提出了合法、合理鉴定医疗侵权民事责任的途径,以期达到科学、公正地解决医疗侵权民事诉讼中的医疗技术问题。The paper analyses the current status of medical tort liability assessment in China,before and after the implementation of Tort Liability Law and demonstrates the binary structure of appraisement system issues which are caused by wrong understanding the notice ＂on judging medical dispute civil cases referring to the Medical Accident Treatment Regulations＂ issued by the Supreme People＇s Court.The authors aim to solve medical technical problems in medical tort civil action in scientific and fair way by identifying the defects of binary structure of appraisement system issues and exploring legal and reasonable medical tort liability assessment methods.
