摘　　要：欧洲稳定机制(ESM)是欧洲在主权债务危机的推动之下,为维护欧元区金融稳定而创设的永久性法律机制,是欧元区17国政府基于《欧洲稳定机制条约》而建立的区域性国际组织。它在国际法上具有独立的法律人格,具有在严格条件下对陷入困境的欧元区国家及银行提供资金援助的职能,在现阶段担负着阻止欧洲主权债务危机传染的重任。作为欧洲的"防火墙",ESM的设立对于维护欧元区乃至全球的金融稳定都具有重要意义。然而,由于ESM的设立和运行不在欧盟框架之内,因而在部分成员国内曾引起合法性的争议,目前由其引发的关于宪政问题的讨论仍在继续。As a response to the sovereign debt crisis,the European Stability Mechanism(ESM)is set up as a permanent legal mechanism, whose task is to guarantee the financial stability in the euro area. Founded on the 'Treaty Establishing the European Stability Mechanism',the ESM,a regional organization established by 17 euro countries,has an independent personality in international law and performs under strict conditions a rescue function for its member states and banks in crisis,which is currently entrusted with the task to prevent the contagion of the European debt crisis. As a financial 'firewall' in Europe, the establishment of the ESM is of great significance to the maintenance of the financial stability in both the euro area and the world. However,because the ESM's establishment and operation is outside the framework of the EU,disputes over its legitimacy and discussions on the related constitutional issues have already been raised in several EU member states.
