农民合作社政府规制需求分析——基于合作社理论与政府规制理论的运用

摘　　要：政府规制是政府为了维护公众利益和纠正市场失灵而规范市场主体活动的行为。农民合作社是因提高农民组织化程度而具有广泛正外部效应的特殊市场主体,如何规范并推动其发展,是政府规制的重要议题。在农民合作社的政府规制背后,有来自不同利益主体的规制需求:一方面,作为规制对象的农民合作社,需要通过政府规制使自身为正外部效应所付诸的成本得到补偿;另一方面,农民合作社发展,使作为规制主体的政府和作为相关利益方的农民、相关市场主体、社区成员以及社会成员广泛受益,他们都有通过农民合作社的政府规制实现自身特定利益的需求。Government regulation is government＇s activity of regulating the behavior of market subjects in order to maintain the public interest and to correct market failures.Farmers＇ cooperative is a special market subject with a broad range of positive external effects due to improving farmers＇ organization degree.How to regulate and develop Farmers＇ cooperatives has become an important issue of government regulation.Behind the farmers cooperative government regulation,there is regulation requirements from different interests subjects： on the one hand,as the regulating object,farmer cooperatives need to be compensated by government regulation for its cost of being put into external effects;on the other hand,the development of farmers＇ cooperation,benefits the regulation subject-government,interested-party farmers,market subjects,community members and members of society.They all have requirements of realizing their own specific interests by the farmers＇ cooperatives government regulation.
