摘　　要：随着知识经济的发展,专利已经从原来的生产制造的手段和方案,转而变成可直接交易,并直接给权利人带来利益的商品。专利的商品化也催生出专利投资理念,并推动知识产权服务业的繁荣发展。专利地痞是知识产权服务业发展的产物。主要探讨专利地痞在中国的现状,深入剖析专利地痞在中国能够得以生存和发展的原因及其未来的发展趋势,并对在现有的制度框架下如何应对专利地痞行为提出对策和建议。With the development of knowledge economy, patent has been changed from the original methods and solutions to manufacture into products that can be transacted directly and can also bring benefits to the patentees. The commercialization of patent generates the idea of patent investment and also promotes the prosperous development of intellectual property service industry. Patent troll is the product of the development of IP service industry. This essay focuses on the current situation of patent troll in China through analyzing the grounds for the initiation and development of patent troll in China as well as predicting its future trends. Meanwhile, this essay also tries to provide some countermeasures and advice against patent troll in the current regime.
