摘　　要：在对知识产权的侵害行为进行界定的基础上,基于流程化分析的观点,对知识产权侵害行为的形态从创造、运用、保护和管理四个阶段进行了分析和梳理,并结合知识产权侵害的不同形态,从立法、司法、执法和守法四个方面对知识产权侵害的救济问题进行相关的研究。This paper analyzes and summarizes the form of intellectual property injurious acts from the four processing phases of creation, utilization, protection and management on the basis of defining the intellectual property injurious act. Combined with the aforementioned processing phases, this paper tries to make a fundamental study of the remedy of intellectual property injurious acts from four aspects of legislation, judicature, law enforcement and compliance.
