摘　　要：风险社会背景下,专利局的有限理性、信息偏在等因素使得传统专利审查模式日益受到挑战。在专利审查品质几乎决定着专利品质的情形下,防止"问题专利"增多的主要策略在于对传统专利审查模式做出变革。为此,可在修订《专利法》第5条第1款的基础上,借鉴国外公共专利评审的制度经验,通过引入公众专利审查听证制度作出适当回应。The problem of ＂questionable patents＂ which has emerged in the risk society has been challenging the traditional mode of the patent examination, and therefore it requires us to learn from foreign experience in the public patent review, and introduce the public participation mechanism on the basis of amending Article 5 of the Patent Law, aiming at changing the traditional patent examination to stop the increase of ＂questionable patents＂ .
