摘　　要：金融调控法律制度是金融市场稳定运行的重要制度保障。金融调控立法的经济学基础在于金融市场失灵和金融信息不对称。秩序和社会整体效率应是金融调控法律制度的价值目标,金融调控法律制度的具体实施应在稳定金融秩序的前提下提高调控效率,且要在提高效率和维护社会整体利益之间找到均衡。为此,完善金融调控法律制度应从建立金融预警法律制度、强化金融调控法律责任、建立金融调控信息公开制度方面进行。The legal system of financial control is an important institutional guarantee of operation of financial market. Finan- cial control legislation is based on financial market failure and financial information asymmetry. Order and the overall efficien- cy of social should be the value of the legal system of financial control. Stability of financial order should be the premise of im- plementation of the legal system of financial control. And the legal system of financial control should balance between efficien- cy and the interests of society. To achieving this object, establishing a financial early-warning of legal system, strengthening financial control legal liability and establishing information disclosure system may be the choice to improve the legal system of fi- nancial control.
