摘　　要：中国大陆刑法学的精神现象,同时也是中国大陆刑法学的学术心态,是我们应予以正视的一个问题。虽然精神现象或学术心态不是刑法学术的"本体"问题,但却直接影响乃至决定着中国大陆刑法学的"本体"的现状与前景。自大与自卑是中国大陆刑法学两种对立交错的精神现象,其所带来的是中国大陆刑法学的"自弱"。中国大陆刑法学者务实于中国自己的现实问题,并在解决中国自己的现实问题中形成自己的概念、范畴乃至命题,是中国大陆刑法学的"自强"之路。Spiritual phenomenon of criminal law science of Chinese mainland shows the academic state of Chinese criminal law science to which we should pay attention.Although spiritual phenomenon or academic state is not the basic problem in criminal law science research,they have a direct impact or even determine the status quo and prospects of criminal law science of Chinese mainland.Self-importance and self-abasement are confronting with each other in criminal law science of Chinese mainland and bring the phenomenon of self-weakness.The scholars in Chinese mainland shall focus on the concrete problems in China and form our own concepts,scope or even subjects of criminal law science,which is a way of self-reliance.
