摘　　要：《刑事诉讼法》再次修改后,有关刑事警察权的内容引发了社会各界的普遍关注。为切实保障人权,对警察权进行监督和控制成为法治所需。通过对行政程序规制警察权的必要性和可行性进行论证,进一步提出完善警察权的行政程序规制路径,以期通过约束执法行为来构建有限型警察,防止权力滥用,保障相对人的合法权益。After the modification of ＂Criminal Procedure＂, the relevant content of the criminal police power sparked widespread concern. To effectively protect human rights, to monitor and control the police power has become the need of rule of law. Through the demonstration of the necessity and feasibiliW of regulating the police power by administrative procedures, further put forward a regulating path to improve administrative procedures, to build finite police by constraining enforcement actions, to prevent the abuse of power and protect the legitimate rights and interests of relative persons.
