论军婚特别保护制度的完善

摘　　要：现行军婚特别保护制度过于关注婚姻关系的外在表现形式,这既不符合婚姻的本质,也存在着侵害军人配偶婚姻自主权,侵害男性军人配偶生育权,对军人婚恋限制过多,实效不强等弊端;完善军婚特别保护制度应着力于提高军婚的质量,通过灵活的政策提高军人的待遇和职业吸引力,加大对军人家属的奖励优抚力度,多创造分居军人家庭的团聚机会,为军人家庭提供物质和精神的双重支持,同时在立法上进一步限制军人离婚否决权行使的范围,降低军婚缔结的风险,真正提高军婚保护的实效。The current special protection system for serviceman marriage pays more attention to the external form of marital relations and imposes more restrictions on serviceman marriage and is of little ef- fectiveness. It is not in accordance with the essence of marriage, and is against the marital autonomy of a serviceman＇s spouse and her birth-giving right. The improvement of the system rests on improving the quality of serviceman marriage. Thus flexible policies should be formulated to increase their wages and benefits, to improve preferential treatment to their family members, to provide them with more reunion time and to give them more material and spiritual support and finally to increase the attraction of the pro- fession. Meanwhile, more articles of law should be enacted to limit the veto power of divorce and as a re- sult, the risks arising from marital ties are lowered so as to improve the effectiveness of serviceman mar- riage.
