高校BT网站与网络版权的冲突与保护——基于“北邮人BT”

摘　　要：北邮人BT(BYRBT)作为高校BT网站代表,在北京邮电大学师生资源传播共享中起到重要作用,但BT网站技术特殊,一直有侵犯他人合法版权之争。为包括BYRBT在内的高校BT网站能够兼顾资源共享与版权人合法权益的保护,从BYRBT网站使用目的、网站及用户的行为来对以BYRBT为代表的高校BT网站进行版权保护相关法律分析,对高校BT网站建议采取符合高校具体情况的切实可行的监管方式。BYRBT,as a representative of the universities＇ BT websites,plays an important role in teachers＇ and students＇ resource sharing in Beijing University of Posts and Telecommunications.However,due to its special technology,BYRBT has always had conflicts with legitimate copyright owners since it was born.In order to balance the efficiency of sharing resources and the legitimate rights of copyright owners,legal analysis about copyright protection of the universities＇ BT websites including BYRBT is conducted from the perspectives of BT＇s purposes and the behaviors of BT＇s websites and users,in order to reduce the websites＇ legal risks.The feasible supervision measures should be taken according to the universities＇ specific circumstance.
