摘 要:目前BOT模式已广泛地应用到我国的高速公路项目上,对于BOT特许协议中的特许期的确定,我国一直采用固定特许期的模式,尚未将弹性特许期应用到高速公路BOT项目中。通过对固定特许期的确定方法及其局限性分析,引出弹性特许期,分析了弹性特许期的内涵及优势,并简单列举了弹性特许期在国外高速公路BOT项目中的应用。并从我国高速公路BOT项目特征、政府及项目公司角度阐述其在我国高速公路BOT项目中的适用性,简述了弹性特许期在应用中可能存在的问题,为我国采用弹性特许期进行高速公路BOT项目的建设提供一定的参考。Currently, BOT mode has been widely applied to China's highway projects, but for the concession term of BOT concession agreement, China has fixed concession term, and does not uses flexible concession term yet. First, this paper introduces flexible concession term through elaborating the method of determining fixed concession term and its limitations, and analyzed the connotation of flexible concession term and its advantages, then lists the application of the flexible concession term in foreign highway projects construction, at last, elaborates the applicability of flexible concession term in China highway BOT projects by perspective from the characteristics of projects, the government and the project company, and outlines some possible problems in the application of the flexible concession period, and provides reference to our country using flexible concession term in the highway BOT project.
