生态秩序“二元构造”的法治化模式研究——对哈耶克社会秩序观的反思

摘　　要：风险社会的现代性诊断范式使我们认识到人类社会已然步入高风险、多危机的生态失序和环境危机时代,回应型和反思型生态秩序的构造提上日程。传统唯理论建构主义的"一元理性"秩序构造模式过度强调人类理性,忽视了自生自发模式的内涵性延展功能。哈耶克的社会秩序观认为秩序的生成模式有两种,一种是人为的或建构的秩序,一种是自生自发的秩序。基于此,生态秩序的构造应该对唯理论建构主义进行矫正,秉承"二元构造"的秩序生成模式。由于生态秩序超现代性的特征,传统道德、习俗惯例与宗教等自发约束手段社会控制的功效减弱。因此,现时代需要运用理性发挥法律控制的基础性工具作用,在不断试错与人类理性的累积下以法治促进生态秩序的健全和发展。Modem diagnostic paradigm of risk society makes us realize that human society has entered into the high risk, multi-crisis ecological disorder and environmental crisis era. The responsive and refletive ecological order construction would be put on agenda. The traditional construcive model of order with exclusive rationality excessive- ly emphasizes human rationality, and ignores the extended functionality of spontaneous model. Hayek~ ideology of social order considers the producing mode is composed of human order and spontaneous order. Because of this, the construction of ecological order should readdress the rationalism construetivism and adhere to the producing mode of diadactic structure. With the ultra morderuity characteristics of ecological order, the social control efficacy of traditional spontaneous binding means such as morality, customs and religion has been weakened gradually. Therefore, it is necessary to play the the basic tools of the role of the legal control, and promote the perfection and development of ecological order with legal system.
